My response:

Unless he has represented you in the past, and some of the elements of that former representation would necessarily "cross-over" into your current legal affairs and litigation, then no, there is no conflict of interest.

I would never represent anyone that close; obviously, the lawyer thinks differently. I don't see a conflict, just poor judgment on the part of the lawyer.

What is the civil case? If it or the divorce would involve information you gave him while he was representing you as an attorney (note that important qualification), it could be a different story.
