In 2013 I got pulled over for turning left off the freeway into a lane that went back onto the freeway. I wasn't speeding, and put my blinker on to safely move over. The police "smelled liquor on my breath" and had me taken to the station to do the breathalyzer there. I blew .08, since I had a spotless record they gave me an exhibition of speed. However I'm really confused about if its a felony or misdemeanor. I've scoured the internet and everything says misdemeanor, but when paying the fees, not only was it more expensive than people online are saying it should cost (I paid about $1500, plus 12 AA classes) I believe they gave me either 3 or 4 points, not just the 2 it was supposed to be. They also made me get into the felony line, and told me it was a felony. Which has stressed me out ever since, and caused me to miss out on jobs I'm sure, due to checking the convicted felon box. I checked my driving record and it just says 23109 c. I don't understand why the court would tell me I had a felony if I didn't though. Any thoughts? Can an exhibition of speed be a felony? I hope to get into the Air Force but if it's a felony then I will probably get denied.

VC 23109 is a misdemeanor (or an infraction) and NOT a felony.

WHY they let you off of a DUI even with a .08 BAC is beyond me! You got L-U-C-K-Y!!!! Or, the officer was lazy or incompetent!

But, if you were convicted of VC 23109, why did you have to take AA classes?? That's an unusual requirement. Or, your county has a peculiar diversion program that you should be very fortunate to have had the opportunity to have taken advantage of.

If this is what you were convicted of, it is not a felony.
