In a nutshell, I have an old credit card that is past the SOL for California. I sent a DV letter to the attorney representing Asset Acceptance on April 12. They have not responded. I sent them the limited Cease & Disist SOL letter since. I put together a nice dispute letter to all of the CRA's with copies of the DV letter, SOL letter, and proof that the SOL has expired. I received a letter from Transunion saying that they could not accept the documentation that I sent. They said that they have opened up an investigation and are in the process of verification. I called customer service and asked her why the documentation was not acceptable and that I needed VALIDATION -- not verification. She said that the CA has to remove the item. I told them that they violated the FDCPA by not reporting that a disputed debt was disputed and they did not respond to my DV letter or request and extension.

What should I do next? Thanks!!!

**Certified mail, return receipt? Do you have a copy and the green card?

They have not responded. I sent them the limited Cease & Disist SOL letter since.

**Not needed. You just needed to send a dispute CMRR.

*True. It can also be removed if the creditor ignores the request for verification.

I told them that they violated the FDCPA by not reporting that a disputed debt was disputed and they did not respond to my DV letter or request and extension.

**Who? The credit bureaus have done nothing incorrect or illegal. Your problem is with the collection agency. The do not EVER have to validate. There is not a timeline in the FDCPA. You lost some rights if you did not dispute the debt with the collection agency within 30 days.

First, go to creditboards.com. You are confused about this and need some accurate info. Go to the Newbie's Section and read until you can't read anymore. Here would be my plan of action:

Send a debt validation CMRR to collection agency.
When get green card back, dispute debt with collection agency CMRR.

Here you have a paper trail--very important. I said CA's never have to validate--unless you do this. This puts the CA on a timeline. They have 30 days to provide proper validation (45 if free credit reports). Here is how it works:

CA verifies tradeline (it stays) before providing validation--violation.
CA provides validation and then verifies--correct way
CA ignores everything--info is deleted.

You only have a good violation if you can PROVE it. The reason you aren't getting results is you don't know what you are doing. Go to creditboards.
