I live in California and my aunt(my dad's sister) has conservatorship over my grandpa and she has said that she doesn't want my mom to pick up my grandpa and take him anywhere not even to our house but seems to be ok with my dad picking him up. My parents have been married for 30 years and we took care of my grandpa up until december of 2000 when she decided to get conservatorship over him. I was wondering if she can legaly keep my mom from picking up my grandpa and taking him out or to our house.

My response:

Yes, since she is the Conservator, she does the speaking for Grandpa. It has the same legal force and effect as if Grandpa were saying, "No", himself. Grandpa can no longer make decisions for himself, and for good or bad, she speaks for Grandpa's wishes. Until the Conservatorship is revoked by the court, she'll be doing the speaking for Grandpa for the rest of his life.
