contempt again

Here we go again. My ex has not paid the correct amount of child support november thru Dec. 12. And after Dec. 12 has paid nothing. She stopped working because her child support was modified from 52.36 a week to 391.92 a month starting Nov.1. She asked me on Friday what will it take to keep her out of jail on 2/20. I asked what she is offering; she stated she thinks $560 and additional $25 a week in arrears is fair. I stated to her she is $1400 behind and $9,000 in arrears and you have no job and it is tax return time.She says that shes trying to get a job but she has to watch the girls and her husband just went to court on 2/11 and the judge made him pay 1200 and I know that her mother claims the girls as dependents. I looked online and her husband did get thrown in jail with 1200 cash bond but he had not been in contempt since 2005. And shes been in contempt at least 2 times a year. Actually our last contempt hearing she was thrown in jail. Her husband has the same judge as us. I think $560 is low considering she willfully stopped working and she is not knew to this process. She always appears in court stating she has other children to take care of and I've brought it up to the judge and cs about the grandmother claiming the girls on taxes illegally. But all I get is pointing fingers to talk to cs, tell the judge, tell irs which I have done. I think she should have to pay the full $1400 but I know that won't happen. So is $700 plus an additional $25 a week in arrears, 3 weeks to get a job and provide proof to the courts that she has a job and that cs is taken out of check seem fair.

Ugghh....make her pay the AMOUNT ORDERED. Tell her if she has a problem with the amount ordered, then petition the court. Her hubby's problems are not yours, nor should you allow her pathetic excuses to fly in court. File contempt on her.

I did file contempt. But I got a call today from the hearing office cancelling tommorrow saying there is a conflict and I will recieve a letter with a new court date. And every time she appears in court the judge cuts her a break or does not follow thru with what he says is going to happen if she appears again.

Keep filing, eventually the judge will just get fed up and actually take some action to enforce the order. Unfortunately it can take awhile, so don't give up.
