What is the name of your state (only U.S. law)? NH

NCP and I have a hearing on Oct 22 for modification of our parenting plan and another motion for contempt (he has already had his drivers license revoked and his outstanding balance reported to the three credit bureaus). I have heard that he is facing potential incarceration for non-payment as the next step. I have Googled, but can't seem to find the NH requirements for that puishment.

He has made a total of eight payments in the three years our son has been alive - five payments of $13.85, two payments of the court ordered amount of $110 and one payment of $90.61. The last payment was in December of 2007. He has a pre-show cause hearing in February of 2008 and signed an agreement to begin payment but still has not made any payments.

How are contempt charge punishments determined? Is it based on the amount of arrearages? The time since last payment?

A: The contempt is based on whether the person could've paid and didn't.

He could pay and chose not to, he has been found in contempt before as well.

My question is more like, "When he is found in contempt again, how is the punishment determined?"

Does the judge make a decision based on what he (the judge) feels is best? Or does NH have a process that is followed?

Such as first time = X punishment, second time = Y punishment, third time = Z punishment.
