My fiance has a hearing March 1st for a contempt of court charge for not paying the bills he was ordered to pay in his divorce. He does not have the money to pay them and his ex wife has not given him any information to contact any of these bills collectors. He has NO paperwork for anything. She left him high and dry, she has custody of their four kids and she got the house and both cars plus half of his profit sharing! He had a terrible lawyer who let all this happen. He did not even get the personal belongings of his out of the house, she would not allow it and his lawyer did not file the appeal in time. It has been a big mess! What I need to know is...........
He is filing bankruptcy on all those bills.....will that stop this hearing? Can he get out of the contempt of court charge? Will he go to jail? Can a lawyer stop all this nonsense? He pays an unbelievable amount of child support already on a weekly basis for the past two years......he cannot afford these other bills on top of all this. He needs money to pay to survive on his own.......what can be done????? Please help!!!!
Thank you :)
Diane

Reply for PA

Its a shame we can't get some kind of group together to support fathers. My X took me through a ringer also, and now I am remarried with a child, and she is still giving us S--T. Its all about $$$$.

You could file Bankruptcy but is her name (X) on the bills and then take the bankruptcy information to court with him.

about bankruptcy

Yes her name is on the bills but he was court ordered to pay half of them and her pay the other half. He is filing bankruptcy on his share. But we are still not sure if that is going to stop the contempt of court charge and keep him from going to jail for 30 days.
I agree their should be some kind of support group for fathers for this kind of stuff.
I recently divorced also but did not take my ex through the ringer like this! I got the house and the mortgage payments to go with it plus all the credit card bills, etc.... He was supposed to pay the 2nd mortgage but didn't so I had to refinance and take over both mortgages to keep the house.
The stuff my fiances ex is putting him through is JUST CRAZY! And you are right it is ALL a $$$$$$ thing! She expects him to pay these bills but she keep taking him back to court for all sorts of money things and every time he has to pay a lawyer, how the H--L does she expect him to pay anything??? GEEZZZ
He is already paying a large amount of money for child support because they have 4 kids. Which of course that he doesn't mind...after all they are his kids too, but SHE does not even let him see them or talk to them. It is just aweful. She just will not let him try and get a life.....although she has one with a man! Go Figure.........

cHILD SUPPORT/VISITATION

vISTATION AND CHILD SUPPORT ARE SEPARATE, HE CAN FILE CONTEMPT CHARGES AGAINST HER FOR NOT LETTING HIM SEE THE KIDS. WHEN IT IS HIS SCHEDULED TIME ACCORDING TO THE ORDER AND SHE DOES NOT LET HIM GO TO THE POLICE STATION AND HAVE A POLICE REPORT WRITTEN UP. SHE CAN BE HELD IN CONTEMPT. GIVE IT RIGHT BACK - WE GO THROUGH THE SAME SITUATION, SHE CAN BE HELD IN CONTEMPT.
