In June of last year I went to my temporary trial for divorce. In the trial the judge ordered that my wife pay $350 of my mortgage. Since the trial I have had to go back to court with my attorney for contempt. Instead of going before the judge my attorney suggested that I sit in with my wife and her attorney to see what type of offer they would agree on. They agreed to give me 4 extra days a month visitation with my son whom I have joint custody over with her being the primary caretaker. I jumped at the chance to spend more time with my son seeing as he is the most important thing in my life. They also agreed to pay payments of $350 every 2 weeks and a payment at the first of the month as scheduled. This hearing was in November of last year and thus far I have received 2 full payments and one payment last month for $100. I have had to continue to pay the full mortgage since it is only in my name and have not been able to contact my lawyer at all since the first of the year. This I think is due to a problem with my attorney's paralegal getting angry with her and quitting her job only to go to work for my wife's attorney almost immediately. I now have her calculated at $2500+ in back payments and as of the past 4 weeks I have been having problems with my ex allowing me to have the court appointed phone visitation throughout the week.

What steps should I take to remedy this situation?

An order is an order, are you receiving the $350/month??

You played right into their hand.

They also agreed to pay payments of $350 every 2 weeks and a payment at the first of the month as scheduled. This hearing was in November of last year and thus far I have received 2 full payments and one payment last month for $100.

So what are you going to do about that, sucker.

That's YOUR problem.

Hire an attorney that is representing YOU.

So since you posted a reply I also have to ask you another question. This IS the second attorney that did absolutely nothing for me in court. So could you possibly advise me of legal representation in GA? I went through this site before and received basically the same response from another senior member which was smart***. Maybe you should try helping people who post in this forum in another way. I came here for advise that I have yet been able to pay for and to try to protect my rights!

Maybe you should try helping people who post in this forum in another way. I came here for advise that I have yet been able to pay for and to try to protect my rights!

And maybe you should grow up! You have no rights in divorce court. Take it up with the judge.

I am going to give you different advice.

Your wife is not going to be ordered to pay the mortgage forever. What is eventually going to happen is that either you are going to be selling the house so that she can get her share of the equity, or you are going to have to be refinancing the house to buy out her share of the equity.

Clearly she is not going to voluntarily pay the amount she is ordered to pay....just move on with the disposition of the house, and ask the judge to order that her arrearages come out of her share.
