I am a homeowner renting out my property in VA. I was in the process of selling the home to the tennants, with the stipulation that I would replace pipes which were found to be flawed in a recent class action suit. My claim was denied based on a timeline technicality. I found a "licensed" contractor who bid within my estimates and he wrote a contract stating that he would complete the work within 10 days, would cover any displacement of the tennant if work interfered with their daily routine, and I paid him for the full job up front armed with his contract.
The tennants called me a week ago, stating that their walls and yard are torn up, they can't use 1 of their bathrooms, and the contractor has not been back to finish the job. No phone calls have been returned. Upon some investigating, I found that he has been using the name of another plumbing company (subsequently subjecting them to several law suits) and is using his father's plumbing license. Because he is not licensed, the licensing bureau will not get involved. The legit company whose name he is using is trying to sue.
What are my options in the mean time? I can sue, but in the mean time cannot collect rent from my tennants, am open to litigation from them, and need to get the job finished. The money is not there, as I spent what I had on this job and expected a quick sale of the house. How can I get this resolved quickly and make this guy pay?
