Ok , so I work for lyft riseshare. I'm sure most know of this company.. I'm currently renting a car through lyft / hertz. I got pulled over by the police middle of the day while on my way to pick up a passanger. Long story short. He pulled me out the car and hand cuffed me and wrestled me a little. And started telling me it was a stolen car, telling me I was going to jail and getting a ticket one way or another , while the whole time I'm letting them know that it's a rental (I doubt they'll rent me a stolen car right?). They ended up leaving. After finding nothing. I call hertz to ask about the car and they were just shocked. I know for a fact that this profiling. I'm Hispanic 25 male with dreadlocks so I assume I look "suspicious". Is there any kind of action I can take? I know it won't be much. But I atleast want to take them to court to show what they did was wrongful.

I'm assuming they'll have video of this incident?

Did you get a ticket?

It sounds from your description that the stop was a questionable one at best and the officer's handling of you unprofessional. But the police could have been responding to a call on a stolen vehicle and the car you were driving met the description of the stolen vehicle. Driver-profiling might have had nothing at all to do with why you were pulled over.

You can file a complaint about your treatment with the police department and you can talk about your experience with an attorney in your area. I am not sure you have a legal action to pursue based strictly on the little you have said.

You can start with a complaint to the agency and ask for some sort of explanation. You can start speaking to attorneys, but very often they will want to see a complaint, first. And, given the paucity of info at this point, you'd likely be looking at an expensive retainer if you want the attorney to do it.

It is nearly impossible that the officer saw a Hispanic guy and said to himself, "Gee, I am going to pretend he's driving a stolen car because I just cannot resist jacking up a Mexican." Sorry, THAT is not at all likely. What is more likely is either (a) the car matched the plate of a reported stolen vehicle or was sufficiently close enough to a BOL to justify the detention, or, (b) the registration came back in SVS or the DMV with a "hit" or otherwise indicated it had been stolen or registered falsely. If you go into the agency and ask to speak with a supervisor, it is likely that someone might be able to explain what happened, or at least look into it. This MAY require a complaint, it may not. You'll have to contact them.
