EDIT: 115mph* not 155

I live in Sacramento, CA if that helps anyone.

Tonight I was pulled over by CHP. Made me pull into a shopping center and made me stop my car, stick my hands out and step out. The whole deal. I was very confused. I do confess, I just bought the car and had dealer plates on so that might've made him suspicious.

He tells me he clocked me at 115mph and it took him 10 miles to catch up. I was doing 70mph all the way from Davis. I had my car on cruise control.

He told me he lost me but once he heard my exhaust (I have full straight pipes) he said he knew it was me.

So by that he can't be 100% positive it was my car that was speeding, he just heard my loud car and blames me. Is there a way to fight this? Can he really nail this 115mph ticket on my without proof that it was actually my car that he clocked? I'm joining the Army and my recruiter told me any traffic tickets can affect which jobs I'm qualified for.

Then I suggest you plead not guilty and hire a good traffic ticket attorney. That's the best way to get out from under this.

And get a quiet exhaust system so you stop calling attention to yourself.

So if this is a used car, has the cruise control been checked to determine it is functioning properly? And I note you don't deny stating you may have been going faster than 70. You throw it back on him.

What made him suspicious was clocking you at 115 MPH. ya think?

Ever hear of speedometer error? When was the last time you had your speedometer and cruise control calibrated?

He told me he lost me but once he heard my exhaust (I have full straight pipes) he said he knew it was me.

Sure he can, he first saw that it was your car that he clocked doing 115 mph the loud pipes just made it easier to find you.

Is there a way to fight this?

Yes, tell the judge he was just picking on you for having loud pipes and have a very expensive attorney and lots of money.
Can he really nail this 115mph ticket on my without proof that it was actually my car that he clocked?
He already has he has all the proof he needed to pull you over didn’t he?

I'm joining the Army and my recruiter told me any traffic tickets can affect which jobs I'm qualified for.

They tell that to everybody, he’s just worried about you not showing up and not making his quota.
I don’t think one speeding ticket is going to ruin your Military career before it gets off the ground.

Btw I could be wrong but the speed limit coming in to Sac on 5 or 99 is for the most part no more than 65 mph, you were still speeding at 70.

If he clocked you he saw the car and possibly you. Why do you think it’s impossible for him to catch up to you and recognize the car he was chasing and pull you over?

Unless this is a quite old car (which would make it even more recognizable) straight pipes are illegal in California. Has the dealer delivered a smog cert when purchasing the car?

If you already purchased the car you should not have dealer plates on it either. You would display the notice of sale.

This is what the state of California says about dealer plates;

Special plate, issued to dealers may be used for any purpose, including pleasure, provided the vehicle is in the dealer’s inventory for sale and is used only by the owners of the dealership or is leased to vehicle salespersons. Special plates may not be used on work or service vehicles (see use of special plates memo issued to all dealers dated December 23, 1983). Special plates are not provided to lessor-retailers.
once a vehicle is sold, obviously, it’s no longer in the dealers inventory offered for sale.

So he probably could have tagged you for no smog cert as well as improper use of a dealer plate.

Please ignore drruthless' comment regarding your Army recruiter, because s/he is wrong. Getting a ticket for driving 100+ mph may very well derail your Army ambitions, affecting your MOS choices. Tell your recruiter immediately what's going on, and take care of this ticket now.

Ken,
What did he cite you for and what was the location of the cross street he cited you on the ticket (Did he cite you 22356? [freeway]) and maybe we can point you in the right direction? Can you give us addtional details on the ticket?
