2 years ago I was terminated from a MA company for using a Amex Corp card for personal expenses. Per Amex, I could use the card for personal expenses. Unfortunately I got to far behind on payments and then Amex engaged with my company. My conpany then terminated me for card misuse and said that this debit is now between Amex and me.

Facts:
I never submitted any expenses to my company for payment, the debits were mine 100%. The company never paid for my stuff.
HR confirmed this is an issue between Amex and me now.
The card was under my name and my SSN.
The debit is on my credit report.

The problem is I have a threating 3rd party company working for Amex trying to collect more money than the minimums I can pay. They are saying this is corporate matter, that VPs are looking to escalate, I can go to jail, etc. If I'm correct, this is still a regular CC debit at this point. I didn't try to defraud my company and didn't steal from them. I used a CC in my name under my SSN is all. Is this company just being the typical over treating collection agency? Should I be concerned or just keep paying what I can?

Also, if I filed bankruptcy would be consider a CC debit and could be included, correct? Any thoughts and suggestions is appreciated.

They are lying. We don't have debtors prison in this country for one thing. Secondly, this is entirely between you and Amex. Your former employer is not involved. Even if the "VPs" wanted to "escalate" the matter, they have no standing to do so. The only thing your former employer had the power to do was fire you which they already did.
