I gave notice of my resignation to my employer on 9/13/04 stating that my last day of work would be 10/1/04. I was a salaried, exempt employee at my job. I recieved my final paycheck today. The pay period stated is 9/23/04-10/06/04. I worked 7 days during that time period. On the paycheck stub i was listed as a hourly employee and given credit for only 32.00 hours of work. I have never been paid as an hourly employee and i do not clock or sign in or out. According to my records I am due to be paid for a total of 56 hours (8 hours a day for 7 days). What rational would the employer have for paying me as an hourly employee (the rate they used is correct) and how did they calculate my hours? Also how do i go about collecting my unpaid salary?
Also it is stated in our emplyee handbook "Resignation is a voluntary choice, freely made by the employee for whatever reason. All accrued vacation to the date of resignation will be paid" I have not used any of my 10 vacation days during this past year so i should also be paid for those 10 days, correct? So that would be 80 hours at the rate my salary would work out to be, correct?
My resignation was due to very personal and pressing issues concerning domestic violence and a immediate need to relocate. My employer tried to convince me to stay and did not understand my reasons for relocation and felt i was abondoning my job. My final working days were not good - as my employer made the working environment stressful and very negative. However, I did all i could to leave in a professional manner and make it easy for my replacement to take over. I feel that they are witholding wages to be spiteful over the resignation and the fact that i have found other employment in my new town so quickly.
