I am taking my daughters father to court for past child care. I filed a motion in Nov. of 2004. We have gone in front of a magistrate several times and he sent it to a visiting judge. We went in front of a judge in August for a preliminary hearing. Yesterday in the mail I receved a letter with the judges findings saying that I have until Sept.15 to file a complaint for the same thing. My lawyer explained that this is no big deal and that he will file it as a complaint but he said it shouldnt matter but seeing as this is what the judge wants then this is what we have to do that the judge feels that we should have filed this as a complaint and not as a motion when I filed this in Nov. of 2004. My question is: What is the difference between a complaint and a motion?
