counselor giving advice

we live in WI...our SC are seeing a counselor over issues with their bio mother who has physical placement, but the kids want to live with us. they are 14, 12 and 11...the counselor told the kids that due to their age, if they do not want to go back to their mother's house, they do not have to. is this correct? i was under the impression that until there is another court order changing original visitation or placement, we had to abide by the original and return the kids at the specified time, days, etc. the counselor is respected in his field and handles alot of custody cases, but i'm not sure about this one..

I agree with LMC. In order for a change in residence to occur without both parents consent, there has to be a court order. You could be held in contempt if you do not return the children to the Mother as scheduled. What I suggest is for you to obtain the records from the counseler and retain an attorney; file for custody. Records from the counselor can be an asset for your fight.

What I am concerned about is why the children do not want to go back to the Mother. If the counselor recommended they not go back, is there a reason that the children told her of? I would be concerned.

that's what i thought. we do have an attorney taking the steps for us, but in the meantime, we are sending the kids to a counselor. Due to many "emotional & mental" issues and some "physical" situations the kids don't want to live with their bio mom and expressed these to the counselor. what they came home with was what the counselor told them. i explained to my hubby "what i have learned from this website" and i didn't think that the counselor was correct. thanks for your advise!! :)
