county jail time vs. state prison

What is the name of your state?north carolina

i have violated probation and will soon be going to court for sentencing. i am looking at 4-7 months. will i have to do my time in the county jail, or the state prison?

The general rule is that if you go to jail for a felony, you will go to the state pen and if you go to jail for a misdemeanor, it's the county clink.

Ask your probation officer or the court to make sure.

-7 months is rather floating time. Normally it's the entire probation time behind bars. I would say it will depend upon how full the county jail is? It's definitely county jail time but they may not have the room. IMO that is the only thing that may have State incarceration involved, is lack of sufficient space. Not familiar with your state. If they have the road gang by the county, that's where you will go. Space to stick you is the key-where?

here in georgia you serve any sentence 12 months or under in a county facility; whether the jail or a work camp. if you are on felony probation and have less than a year left on your probated sentence. the balance would be served in county and in most counties you would get "good time" and only serve half of the time. however, north carolina could be completely different. check w/your po.
