Couple wants NCP to pursue his dream

My cousin and her husband have a two year old. He has always wanted to pursue writing full time. He has had articles in magazines, but works as an accountant and hates it. My cousin and husband have agreed that she will continue to work, and to pay his CS, and he will be a SAHP and write. They have no intention of asking for any modification while he is building his new career.

He contacted CS in IL to arrange for her to send payments, and they are telling him that they will only accept his income witholding. Why can't she just send them payments?

When his ex asks for a modification, whose income will they look at if she's the one paying? Also, if she's paying for him, even though he has no income. when he starts making income, is his writing income EXTRA? Or should it not count until it exceeds what he makes now?

Illinois will accept any payment made to CSE....just be sure never to use Cash(no traceable) or Credit Card (if he ows arrears and they have the number on record they may try to take the whole arrears as a valid charge). They will send a statement 1 x per month with what he owes.....you must return the statement with each payment.

Audster, you amaze me at your knowledge of the system. Do you know someone who was caught with credit card. I have never heard of this. Is this state law or federal? Just wondering.

Actually I know someone who made a good faith payment with a Visa who owed a little arrears. he had some medical problems and was out of work for about 6 months. I think he was in the nieghborhood of $700 behind. The minute IDPA/CSE got his credit card number, they charged the whole amount to the account. Of course that's just heresay....His side of things, nothing I could actually verify! i recomend wage withholding as a form of CS payment...that way when your ex tries to jump jurisdiction and files for PA in a different county or state you have definite proof of payment!

If thats not possible (stay at home parent/business...whatever) you should send a Cashiers check. Make sure it is to CSE and not to the EX because payments made directly to the ex are can be considered gifts and not valid CS.

And, yes, I've dealt extensivly with Illinois CS Enforcement.....covinced that they are run by inept, barely literate morons
