My fiance is 12 days away from his court hearing (in NY) in which he is bringing his ex-wife to court for violation of visitation among other things. In the past, she has been represented by an attorney. He has represented himself and will do so this time as well. He sent a letter to the judge on the advice of counsel (a family friend) with all supporting documentation i.e. court orders, letters from son, tape transcripts. We called her attorney to see if he was representing her that day with no response. The last we heard from this attorney was when we sent him a letter regarding visitation prior to this court case. His secretary called and said he doesn't represent the ex-wife with visitation. Since the case is about visitation should he assume this attorney will represent her again, call him again to inquire about him representing her and does he have to send a copy of the letter to the judge to her attorney or her, if she winds up representing herself???
