I'm a father who was falsely accused of domestic violence. I ask the court to order family counseling for myself,ex-wife, and 3 year old daughter at the time 1995. this was to show the courts that my ex was lying. The courts ordered that we all attend counseling and granted me visitation. This has not happen since the order. I've tried having her served for contempt of court, but she's on the run and keeps moving when any sherriff or private server attempts to have her served. Her family and friends are running interferences for her. I've recently located her again, but she is far away in the state of Texas; I'm in Virginia what is my best legal move.

I'm not sure as to the laws of Virginia, but I live in Texas and do know most of the laws here. Have you tried to have enforcement(contempt) papers sent Certified Non Resident thru your District Clerks office? I know they do it here in Texas. Then you could get a "Capias" issued on her if she chooses not to show for the hearing. This is a tedious procedure because after all this you still will have to file other motions depending on what results you are looking for. Do you pay child support? How does she get it if she keep moving? You may also need to hire an Attorney if you are looking to get Custody? If you are just looking for visitation and that has been denied to you that also needs to be in you Enforcement papers.

I am not an Attorney but do have some legal knowledge in this area.
