I will bet no replies are received on this one.

When the court royally screws up who is held responsible?

Michigan Court Rules clearly state that certain language MUST BE included on an order of judgment. Today, a court issued a twenty year old judgment form to the parties. The plaintiff won. The defendant lost. But the judgment is void and legally unenforceable due to the omission of required language by statute. The court reporter or clerk obviously grabbed a terribly old form document and the judge executed it. Is the defendant off the hook and will the plaintiff have to start over?

What Michigan Court Rule renders the judgment void? Can you cite that rule?

Regardless, all it would take from the plaintiff is a motion for a nunc pro tunc order. The law looks at substance not form.

And my bet is that you won’t be able to respond by citing that particular rule.

My second bet is that no one will top that inane question in the next 30-days.
