I live in Michigan and this is in behalf of my fiance. She was served with papers for appearance in court on Monday, June 4th. On the summons papers it states that the dates that she must be served with in (may 17-28). She was not served until May 29th, 2001. Does she have to follow the directions on the summons and appear on the date or is the summons void since it did not fall with in the stated time to be served in?

She has visitation with her two sons 3 weekends a month during school and then 50% of the time during any vacation.

He ex charges that she is not buying clothes, sleeping over with her kids while I am present in the house, and being pregnant. All of course are false. He has been convicted of domestic abuse and we have two police reports of child abuse from him and his new wife.

We are to be married June 2. I am looking for some leagal information about the summons and what she and I need to do. We are currently trying to get information on a lawyer, but with the wedding plans and this last minute summons it will be hard to do in such a short time. Also the costs of a lawyer are a problem.

Thanks

Dan
