I divorced my wife after 25 years of marriage, we have a
daughter who has down syndrome. The court ordered me to pay
alimony and give my exwife half of the savings and I had to
pay all legal fees and pay off all debts. I was informed by my attorney that after I retired my alimony would probably
be eliminated because my exwife would received approximately
half of my retirement. The divorce was final in 1996, in
Greene County, Ohio. In 1997 I was informed I needed a
second back operation due to several ruptured discs (I
had one operation in 1989). In Jan 1998 I had the operation
it was a failure, I had to have a second back operation 3
months later. I was off work from Dec. 1997 until Sept 1998.
Even though I was still recovering from my second back
operation that year I went back to work early as the doctor
told me it would take about a year to recover. The reason
I returned early was that my company was going to reduce my
benefits if I didn't. In Dec. 1998 the company offered me
a special retirement the benefits were better than a medical
so I took it. My retirement was effective Jan. 1st 1999.
I informed my attorney what was going on and he said he
would take care going back to court and informing them of
my retirement, as I said my eswife would get approximately
half of my retirement. I went to court in May. In April of
1999 I found out that the third back operation was a
failure also. I went to court with a letter from my doctor
stating that I could not work and was under his care. The
courts decision was that I was to young to retire, (I was
56 at the time) and that I did not have to retire. I
explained that both myself and my exwife benefited from
this because we both received more retirement money. The
court ruled against me. They said I would have to continue
to pay the same amount of alimony which, took all of my
half of my retirement with the exception of 65.00 a month.
My attorney said we would win on appeal. My present wife
had just purchased a home in Florida, my attorney said go
ahead and to Florida that everything would be ok. My
attorney appealed and lost. The court contacted my
employer and informed them to send all my retirement to
my exwife. Since living in Florida, My condition has worsened I now have to take morphine three times a day just
to get out of bed and since all of retirement goes to my
exwife, I now have to pay for my health benefits. I have
no income and cannot work, how can a court take all of
my income? my present wife now has our house up for sale
because she also has a medical condition that keeps her
from working also. I have tried for social security disability benefits but have not received any to date. What
can I do?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Sounds like reversible error. I don't think your atttorney did the correct work necessary.

Your only solution is to get a new attorney and go from there.
