What can be done about DCFS/CPS workers seriously overstepping. My pregnant daughter who is three weeks away from her delivery date was cornered and held in one room while the children were interviewed by another. When she tried to call her husband at work to come home, her phone was taken away. When she was let out of the nursery (new babies) room, she sat on the couch, went to stand up and the woman stood in front of her and blocked her and then said where do you think you're going I am not done with you and would not allow her to get up.

She was accused of having drugs in the house, which were over the counter anti vomiting pills, her husband took while he had the flu. A new unopened bottle was purchased and presented to them to prove they were the pills she told them they were. The woman had told her that they were xanex and not to lie to them, she knew what xanex looked like. Husbands sister ran up to the store and bought a new bottle back showing them they were not xanex.

She was told to get rid of the childrens two pet cats because they will make her unborn child retarded. That no one should ever walk around in a house without shoes on, it is unsanitary. Demanded she shampoo her carpets due to the cats "walking" on it.

The children have a therapist who meets with them several times a week, due to their mother and her issues. Mom (NCP) beat them over the weekend and overdosed her 8yr old. When kids were returned home they were taken to the ER and dad called the kids therapist as well. All three, dad, ER and therapist made report to childrens services. They showed up at dads house acting as if the report was against dad and step mom (my daughter). Then told my daughter there was no way that they took the children to the emergency room, the doctors wouldn't "put up with that sh*t), to which daughter pulled the discharge papers from the Er off the counter to show her they were in fact in the ER.

Childrens therapist was present when dcfs showed up, they were unaware she was the therapist. The CPS worker told the therapist to leave the residence, and my daughter told her no, it was her house she could stay. Therapist has made a formal complaint over the issue They literally went through every thing in her home, opened cabinets, drawers.. it was a search conducted like the police would do via a search warrant. Therapist called dad at work to come home, dad came in and saw my daughter crying in hysterics because she was being told her unborn child would be retarded due to the cats, and they were going to take the baby, he told them to leave and contact their attorney. Yes, they have an attorney, but he is for daughters upcoming visitation hearing with her ex. They cannot afford to pay him more to deal with the state workers, if he even can.

House was not dirty, cluttered yes, with five children playing it is an every day occurrence. After dinner all the kids pick up their toys, take a bath then go to bed. They have a very large home (5 bedroom, two bath, two living rooms and a den) and while I can say it does look like pure chaos at times, due to five children running and playing.. it is never filthy. She has plenty of food, all kids have own beds. Blah Blah Blah..

Dad and his sister and therapist followed the workers out, the one that was very aggressive to my daughter had a bottle of beer sitting next to her in her seat. When asked why she was driving around with beer, she said we just came from a conference and I confiscated it off a 15 year old boy. (*cough*)

My daughter is now in premature labor, and in labor and delivery. Considering the stress she was put through, I cannot say I am surprised.

I am going to head to the hospital now, and check back as soon as I can. But any advice how to deal with this situation would be appreciated. The therapist was in tears and one of the other cps workers that was there kept trying to make the one aggressive woman calm down.What is the name of your state (only U.S. law)?

Your daughter and son-in-law should definately get a consult with an attorney, especially since the children's therapist was present and a witness.

You posted this this morning, how is your daughter doing now?

6lbs 10oz 19 1/4 inches. They did some kind of test because he was determined to be 35 weeks not 37 and they are keeping him under observation until Saturday.

He was born at 1:08pm, I was three minutes off, I said it would be 1:11pm.

Mom is ok, stressed and worried they will come take her baby from the hospital. She tried to go with a natural birth so if they wanted to drug test her she would be totally clean. She managed to make it until she was dialated between 6-7 before she screamed out "Ok Epideral time!" She delivered a couple hours after.

I have my first "official" grandson. He is beautiful, I just wish my daughter had not gone through what she did bringing him into this world.

Your son-in-law should get a consult ASAP if he can.

This just makes me shake my head. Dad needs to absolutely consult with his attorney and maybe even consider a lawsuit against CPS due to mom's premature labor and birth of the child.

The bits about the cats were simply out of line. Refusing to allow your daughter to call her husband was out of line. There is so much out of line here I am not even sure what to say.

Update

The therapist put in an official complaint, then her supervisor actually contacted the head office over the local county office to also complain.

The other day the head of the main office (not local) made a surprise visit. She apologized over and over, told my daughter there was nothing wrong with her home and had spoken to the children's teachers and therapists. Actually complimented her since the children were out of school, all at home, and there was a newborn baby in the home as well. She said she certainly couldn't do the job my daughter was doing, or as well as she was.

One of the other workers who was at the house when this all went down also filed an internal complaint regarding the way the situation was handled. There apparently was also an admission that the worker in question had actually been drinking.

The woman who came out took statements from my daughter, the older children and then went and got a statement from the therapist as well. At no time will the original case worker ever be allowed back on my daughters property and is under review, likely to lose her job. My daughter said thats all fine and good, but does not negate the fact that we have consulted with an attorney and all future questions should go through him.

My grandson is doing ok, he has lost more then the expected amount of weight since birth (almost a pound at two weeks old). They just started him on a new formula to supplement my daughters nursing since he was constantly vomiting the other formula, and she is having a hard time with milk production. The doctor will see him again in a week and they put him on some kind of medicine as well to help with the nutrient absorption issue he is having. But both his doctor and her obgyn have stated that she should have gone full term, and it is their belief the early birth was brought on by traumatic stress.

But on the upside, he is the prettiest little tiny thing I have held in my arms in a very long time. And you can all call it gas or reflex, but he smiles when I rub his chin or call him pooter.. =)

I am SOOOOO glad that the therapist was there to witness all of that. I hope that caseworker does get fired. She should be.

I have had some run in's myself with CPS, due to false complaints being made, and I have never personally had a problem with them. They have always been very polite and never asked to search my home. Only once was I ever asked to prove that I had food in the house.

However, I have heard horror stories like your daughter's from other people. Any time they can indentify the bad ones, and get them out of the picture, its a score for the good guys.

They basically did the same things to me, THREATS< coercion, manipulation, omission of information/facts, violating visiting rights, lying to the judge, presenting false evidence, and basically they never had a valid claim against me in the first place.
I believe this would be frivolous litigation and a pretty flagrant waste of taxpayer monies, since i have never abused or neglected my children, nor have i ever been found to be unfit to care for them. i am completely clean,sober and drug free, as well, so those kinds of things were never an issue.
If i can prove that there were no justifiable grounds to take my children in the first place, and that the State never even had a case against me, then is there a way to possibly get the Supreme court to issue a ruling reversing or vacating the baseless, meritless order to terminate my parental rights, without any legitimate proof established that it was in the children's best interest or that the agency even made what is referred to as "Reasonable efforts" to make it possible for them to return home???
(i also have TONS of other issues that i would be glad to mention, so please ask away!!)

I don't think their action is sufficient. I would argue that if the caseworker has not yet been fired, there is a systemic problem.

To me, the scariest thing is that there was not one rogue caseworker involved. There was a rogue caseworker and another caseworker who didn't do anything about it. I can understand one bad caseworker, but when the other one allowed it to continue, that means that there's a much bigger problem than the one worker.

I would strongly encourage the attorney to file suit immediately. You can easily agree to drop the suit once the following conditions are met:
1. Caseworker is filed with a formal reprimand in her file
2. You are reimbursed for any and all legal fees as well as any portion of the hospital fees caused by the early delivery. (I wouldn't be surprised if attorney takes this one without requiring payment from you).
3. CPS must implement formal procedures to ensure that this situation never arises again. I would argue for annual reviews by an outside auditor, as well.

And, if (heaven forbid) there is any permanent harm to the child, they should be held responsible for that, as well. If necessary, you should go to the local TV station, as well.

It sounds like there's plenty of evidence to back up your claim. CPS plays an important role, but unless someone applies the reins, their abuses can be extremely damaging.
