What is the name of your state? Florida

My fiance has been getting calls from a collection company trying to collect on a debt that dates back to 1992. After reading through this site and all of the advice that you all have given, I told him to write a Cease and Desist letter so that these leeches would leave us alone. They even tried to intimate that he agreed to set-up a payment on the outdated account. He wrote the letter and sent it certified mail. Well anyway, today the company called back and was questioning my daughter when I took the phone. I asked if there was a message that I could take and thats when Mr. CA started to ask me whether we were married, were our finances joined, how long we were married (we're engaged), etc. I asked him what does this have to do with this phone call and any messages that he wanted to leave. He says everything. I want to know what is the next legal step that can be taken and how soon I can have this harassing CA silenced? I know that the company is located in Rodkford, Illinois (company name - CAMCO). HELP!!! This is really a nuisance on an account that doesn't even show up on his credit report.

You may wish to call your phone company and tell them you're being harrassed and can they capture that phone# from Camco. If so, I'd sue them in small claims court right now for an FDCPA violation.
http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm

Look at 805 paragraph c says it all. You can be awarded up to $1000.
I'd suggest you file a complaint with the FTC at www.ftc.gov
I understand they have an active investigation ongoing against Camco. Also, email a complaint to the IL AG and, the BBB.
You may also post this at www.cardreport.com and ask for scott and reference Camco. We call him the "the Camco Killer".
Finally, go to www.ripoffreport.com and type in Camco in the search box and you'll see this is their normal procedure.

Definitely get hold of Scott, he has a special vendetta against SCAMCO !

Just an FYI, as I'm sure you may know, the SOL on this debt ran out a LONG time ago - SOL is 4 years in FL !

Thank you for all the info. I went to the other site to try to contact Scott. I found out that CAMCO is protected under some sort of legislation by the state of Florida. I don't understand this. There was some class action suit against CAMCO in Tampa, but they couldn't do anything with it because of the legislation and the protection of the state. I already contacted the FTC and we already sent the Cease and Desist letter. What can I do now?

That dosen't sound like Scott! Did you actually contact him or, read some old threads? A lawyer in Fl. was trying to form a classaction suit against Camco for merely trying to collect SOL debt. That didn't fly.
You've every right to sue them yourself in your local small claims court for FDCPA violations.
Did you read the FDCPA and send the emails to the places I suggested?

Camco

I wanted to thank you for all of your helpful information. I contacted Scott and am waiting on a response from him. I will let you know what he says and how I'm progressing with this bogus company.
