What are my rights in regards to negative credit information that cannot be verified by CRA?

I have already submitted an investigation request with credit reporting agencies, to which they have replied by stating "unable to verify".

Next I sent two letters to the alleged creditor, asking them to contact me so that we can clear up this matter. I received no reply from my first mailing, so I sent a second letter, certified. It's been almost 2 months since my letter was received by the creditor, and still I have heard nothing.

The tradeline is listed as a "charged-off account". Which severly affects my credit rating, if I legally owe the money, I want to pay it, if not I want the tradeline removed. But I don't know what to do next. Any advice?

If it helps any, this account was a vehicle lease, I did not roll the vehicle over, at the end of my lease, but instead gave it back. 3 year lease, I leased in April 95, gave back, early May 98. Creditor alleges that I stilled owed them for 1 month's lease. $400.00

If I recall, I received one notice regarding balance owed, in June 98, that was it. Account was charged-off by 12/98.

Dear tjkmf,

If the credit reporting agency does not receive verification from the creditor within 30 days they are to remove it from your credit report in accordance with the Fair Credit Reporting Act.

I suggest you send the CRA a certified letter demanding that they remove it until such time as verificaiton is furnished by the creditor, then you can negotiate a settlement with the creditor.
