credit issues with car loan due to divorce

My wife and I bought a car 8 months before our divorce. Both of our names were obviously on the loan. Then we got divorced. The agreed settlement was that I would take all the credit card bills, the mortgage, and obviously the house since I was paying the mortgage. She wanted the car so the only responsibility that she took with her was the car payment. It was all agreed upon nice and neat, no arguments.
Now, two and a half years later, I have hits on MY credit history because she has not made payments on the car, she has been late on payments, and I am getting calls from a collections agency, I can only assume is from the car since that is the only thing that currently may possibly link her to my phone number. Obviously, they cannot legally tell me anything, but her neglect is damaging my credit.
I have worked my entire life to maintain perfect credit and now she is wrecking it. Since the divorce settlement maintains that this is her only responsibilty, can I force her to refinance this loan, or is there some way that I can get my name off that loan or dispute the damage to my credit history?

The first thing that you need to do is pull your credit report so that you can make certain that its really the car, and nothing else.

Once you know, then get a consult with a local attorney.

Why can't they legally tell you anything? If you are still on the loan then it is your debt as well.

You can't dispute the damage due to the fact that your name is still on the loan and hence you are still legally responsible for the loan. You can ask the court to order her to get the loan out your name.

Furthermore, the court, financial institution or your ex-wife do not care that she is wrecking your perfect credit.

Lesson for others embarking on a divorce. Get a court order to refinance the first time around and hold the other party to it.
