I am filing early in the A.M. tomorrow, under the emergency terms, and I have a question concerning a creditor that will not give me any information on a collector that they have contracted for my account. I informed the creditor, in person today, that the BK was going to be filed tomorrow, and that I believe that I needed the contact information for the collection agency which they told me was just contracted by them today to collect on my account. My question is really two parts I guess: A) Should I just list an "unknown" agency beneath the original creditor when I complete the Schedule? B) Should I mention the uncooperativeness of the creditor to the court when I initially file, or anytime within the 15 day window when the petition is completed?

I'm not certain if it is legal for them to refuse that kind of information, so I would be interested in hearing opinions on that as well if anyone cares to share.

If this account has only JUST been placed for collections and not charged-off yet, then don't worry too much about it - the original creditor still owns it. As long as you list them, you will be covered. That will get your emergency petition filed.

In the next 15 days, you'll have time to find out who the collection agency is and, if necessary, amend your creditor matrix.
