CS mod hearing question

I have a CS mod hearing coming up in a few days. I can not seem to find an answer to a question i have.

i am the NCP there is no court order custody nor visitation.
CS is currently on hold at the moment due to ex interferring and costing me my job. she is now the one requesting the mod hearing. I have recently found out that our 5 year old daughter has not been living with her for the last 2 1/2 years but with my ex's parents instead. she basically handed her over to them due to situations that would go on in her home. her and her current BF would always get into an all out fight. her bf did not want my daughter around him but is theone pushing my ex to keep trying to increase the CS.

So the question is. is there any way i can mention and have the current CS sent to the grandparents that our daughter lives with?
or would that have to be dealt with a custody hearing?

i am planning to file and attemp for full custody soon after i get everything gathered that is needed. but i doubt i would win cause of the size of apartment i have and current son that lives with me. so i am hopeing to atleast if i lost show the judge the proof of how my ex is and keep daughter with grandparents .

Your X is NOT entitled to CS if the Child is NOT living with him/her.

Why didn't you deal with this 2 yrs. ago ?

You mean to tell us you have been paying the X these 2 yrs. and the Child Lives with the Grandparents ?

Get some Proof the child lives with the Grandparents .

When you both are in Court bring it to The Judges Attention.

What happens to the CS payments you have been paying ?

yes i have been paying the CS to my X for the last 2 years when it was active. right now CS is suspened and has been for the last 6 monthes.

What happens to the CS payments you have been paying ?

they get set to the state dispercement agency and then sent to X. what the money gets spent on i have no clue. i could guess but no proof but it is not beeing handed over to the grandparents cause i get the lovely lectures from them.

edit: the lecture are not direct they are indirect from them telling others that talk to me that i am not paying for my kid and getting away with it.

i do have solid evidence to prove that our daughter is living with her grandparents now. other then the hear say i had a week ago.

i'll bring it up and hope it gets delt with if at the mod hearing. if not then it will be pushed at the custody/visitation hearing.
