I can pretty much guarantee that the SOL would be a bar in suing the state at this point. Whether there might be something that would still have the SOL open against the drug manufacturer, I don't know, but as you note that may well be a problem, too. The OP ought to see a personal injury lawyer for help with this, I think.
I agree that a personal injury attorney might be able to at least ascertain whether there is any legal action available to pursue. Although it seems unlikely that there is after this amount of time, it is because we don’t yet know why the concern over Paxil is arising for Ouchmybrain now - and also because of the history of this drug - that a personal review could be important.
