Custodial Parent and Health Insurance-PA

What is the name of your state? Pennsylvania

My husband's ex wife just petitioned the court to carry the children's health insurance. She is in Missouri and didn't like us tracking the children's medical welfare through the insurance. (She won't tell him anything)

Now that she is carrying the health insurance, does she have to turn ID cards and all the information necessary for him to use the insurance over to him? She is claiming she doesn't. If she does, what does he have to do to get the information out of her. :confused:

Too bad if she doesn't like it. He is legally entitled to that information regarding the children and there isn't anything she can do about it.

If she has petitioned the court, then they have yet to render a decision. Your husband has the right to object to her carrying the insurance (he has better coverage, more economical, etc). Your husband should also mention to the Judge his ex's blantant refusal to give him any medical information regarding the child (again, this is info he is legally entitled to). She would also have to explain why the need to change insurance (this is where your hubby throws in his ex's contempt to provide info).

Most states have statutes regarding the other parent making available this information regarding their children. Look it up.

If she winds up providing the insurance -- YES -- she would be required to provide all necessary cards to him so the children can seek needed medical attention.
 
She asked to carry the insurance during a modifcation hearing. The order went in October 12th...so we're past the 10 day review. Even if we argued against it, she would still use the insurance and just not tell us. At least we don't have to pay for insurance she's not using and I'm hoping this way she'll have to turn over information.

Belive it or not...custody is not settled. It has been dragged out in two states for three years. It is my understanding that even if she got sole legal custody...he would still have access to their records. Right?

Unless he is barred from getting such information, I would suggest he remind her that he is legally entitled to that information and she is REQUIRED to make that information available to him on request.

If she doesn't like it, tell her to stick it in whatever she feels and to smoke it.

Also, just because she will be carrying the insurance does NOT mean that he won't pay for it. Since insurance is considered part of child support, his support amount could be increases. Just an FYI.

The order is done. He broke even on the insurance. We're actually paying less now because he had the daycare costs removed. She never reported she quit work a year ago.
