What is the name of your state? Indiana. Mother was Custodial Parent when child incurred a large medical bill due to sickness. There is a payment plan for bill. Father then became custodial parent and now receives CS. He now has the child and CS which includes 6% to be used towards uninsured expenses. Even though hospital presumes Mother is responsible, do Indiana guidelines address the issue of which parent SHOULD pay for the child's medical expenses? Each month that Mother makes a payment on this bill, it is an uninsured out of pocket expense and CS guidelines say that uninsured out of pocket expenses are Father's responsibility. If Mother continues to pay, isn't she in effect double paying, i.e. both the hospital for current amount due, and Father for CS? Father believes that because the bill was incurred prior to his custody, it isn't his responsibility to pay it. This bill was not available during the custody hearing so wasn't specifically addressed by the court at that time. Any established presedence or interpretation of the law on this topic would be useful and could help avoid seeking the advice of the court. An example of a similar situation would be if a child had braces on his teeth and CP had a payment plan with orthodontist. If custody changed, wouldn't the burden of payment rest with the CP? I can address reimbursement of this expense w/CP at a later time in court if he doesn't agree. I just want to establish whether it actually is considered his expense.
