THIS ASE STARTED IN PENNSYLVANIA. MOTHER & FATHER ARE ORIGINALLY FROM PA. FATHER LIVES IN WASHINGTON STATE. PA GRANTED FATHER CUSTODY TWO YEARS AGO. MOTHER NOW RESIDES IN SWEDEN. PA. GAVE CUSTODY BACK TO THE MOTHER ONE YEAR AGO. FATHER WANTS TO MODIFY CUSTODY IN WASHINGTON STATE. WHAT STEPS NEED TO BE TAKEN AND WHAT PAPER SHOULD BE FILED IN WASHINGTON STATE?

Where is the child?...and how long has the child been there?

My daughter is here in washington state for the summer. She resides in Sweden with her mother. She was born out of wedlock. Mother still maintains her US citizenship, so does my daughter. Mother is supposed to be marrying Swedish boyfriend.

You are going to have to consult with an attorney. If the mother was already living in Sweden when the courts awarded her custody, then there may be nothing you can do. However, if the mother just up and moved the child to Sweden, without your agreement, then you may have a strong case for WA to take emergency jurisdiction.

However, you honestly MUST consult with an attorney.

Mother was not living in sweden at the time of case. She was still as resident of Philadelphia. She still maintains her US citizenship.

you just have to file to change jurisdiction. seeing as neither parents still reside in PA you shouldn't have any problems transfering to your state. talk to your county clerks office and they can direct you to the right forms. i would get it done now while child is with you. so jurisdiction isn't changed to sweden
