Hello,
My mother is the primary power of attorney (POA) for health and finances of my father. My question is what situation can I take over as primary, aside from her volutarily giving it up and or passing away? Currently I am second in line should anything happen to my mother. I feel that my mother isn't giving the needed care for my father. My father has had cancer and stroke. He can barely walk, speak well, and is getting contractures on his right arm and hand. All these handicap can be overcome with enough therapy.
Would abuse and negligent convince the courts to make me the primary POA? I do not see why she does get him the care (speech therapy, physical, occupational, etc.). he needs. My father has the money. Maybe she wants to make sure their is a lot of money left over when he passes?
