Please help. We are seeking the custody of my great niece. She is 5 months. Her father, my nephew, is currently hiding from the police, out of state. He has a probation violation. The mother, 16 is with him. They have no regular employment and are using drugs. They have left the baby, Annslee with me and my mom for the past 5 weeks. They have visited for a day or so, they also called 1 time in past few weeks. They want to take Annslee when they want to, its seems to get them access to people's homes. We have tried talking to them. We don't wish for them to never see Annslee, but we want her to have one stable home. We don't have the money for an attorney. I want to file the temporary custody papers with the probate court here. My understanding is that we have to have them served at the last known address, if they do protest our getting custody the case would be transfered to Juvenile court. We want stability for Annslee! We are now buying her clothes, milk, toys everything. We doin't need financial support. Again, we want this child to be stable and cared for evcery day. If her parents can get straight, work and provide her with a home, we would be glad for the baby to live with them. Not now, going from place to place with a backpack, staying who knows where. I fear they will get high and let something happen to this baby. She is so sweet. She thinks we are her parents. Please help. Is it true that id they don't protest our petition to the probate court that I can have her as her legal guardian? Would that prevent them from coming to take her away on these trips for two or three weeks, where they have no permanent residence?

FIrst you need to file an emergency petition for custody.
Next, you need to call the police when the kids show up and have them arrested.
