My divorce was final last year. I have a 15 yo that lives with me. My ex and I agreed to share custody, so it was never brought up in the divorce. Now, since time has passed, she only pickes up our daughter up maybe once or twice a week, and some weeks not at all. It would be nice to have a set schedule , but at the time it didn`t seem like this would be a problem. It seems like her Mother is rapidly loosing intrest. She always has excuses as for not picking her up. It would be nice if I could plan on a few things myself but with no schedule and her unavailability it is hard to do. Is it too late to file for custody and suport from her mother since I can tell by the way this is going she is getting less and less involved with her?Right now she is 20 inutes away and doesn`t see her much. She will be moving an hour away soon , and I know what will happen then.

File for a modification establishing a set schedule. Even so, visitation is a right, not an obligation. You cannot force her to care enough to want to see her child.
