Filled chapter 7 and included the house without redeeming. Stayed for a year but couldn't pay anymore and let it foreclose. We are at the end of our redemption period. The lender bought the come back at the sheriff sale.
My question is can the lender sue me for wear and tear damages to the home? We have lived there a very long time and did not have the money to maintain the home the way it should have been. The carpets are old and basically destroyed, the wood floor is in bad shape also. The furnace is making some sort of noise, I have not had it looked at since it is not needed in the summer. There are some leaks in the roof, and possibly some damage in one of the walls. The grass is a bit overgrown right now and so are the bushes.
The other problem I have is I do not have anyone helping me so there is going to be some appliances and furniture left behind. Also the kitchen sink had a pipe that was leaking so a friend of mine turned the water off (no damage) and removed the pipe but did not put a new one in. Will I get in trouble there is no pipe? The rest of the sink is there.
We did not damage the property in anyway, it is just rundown. I am assuming there is no Cash for Keys since we have not been approached by anyone. Can we get sued over any of this?? Thanks.
