What is the name of your state? California.

Need advice on Songwriting and publishing contracts between singer/songwriters and music producers as pertaining to digital distribution and online sales, licensing and royalties.

I am a homemade internet recording.
I download instrumental music created by other artist like myself from all over the world from sites like
[listing of URLs removed]
All creative common license sites that offer free music download’s from composers and producers all over the world.

I write and record lyrics to these songs and post them for free downloads for the most part.
I often times post my material as acapellas and allow downloads. I have over a thousand or so downloads of my acapellas and many producers contact with the intent to ‘release’ a remixed version of my pella to their music.

Recently I have embarked on a plan to record and release a digital album for public download for a price on site like Amazon, Itune using TuneCore.

I decided to create my own publishing company and register it under a DBA with BMI.

I’ve done a lot of research however I am not sure of the following issues:

Copyright
As far as copyright ownership, do I registers the songs with both
the producer and I as owners?
Can I register my acapellas that I have created by themselves?

Contracts
Is it possible to do simple 50/50 between me and the producers, such as a songwriters agreement, minus the fees associated with releasing the album and Administrative Deal using my own publishing company to promote the album? Would that be sufficient?

What about publishing and royalties? How do they fit into that equation?
Digital Music
What about ring tones and downloads is this covered in a standard agreement?

And any other piece that I am missing, any type of help that can be offered, information or point in the right direction to accomplish this task you can give me that my little brain has yet to discover as a major component of this process would be most kindly accepted. I don’t mind reading and researching just need help getting the correct information.

Thanks so much.

Generally, I would put my name as claimant and the publishing company as the rights and permissions contact. Performance royalties will be handled by your agreement with the PRO (BMI). As for negotiating other points, that's between you and the publisher.

This is not an attorney referral board. Use the orange "Find a Lawyer" button
