My wife runs a small in-home daycare. Today the mother of a 3 year old girl my wife watches claims that her daughter said that another 4 year old boy hit her and said that he was going to "f*ck" her! This is obviously something my wife would not allow to continue if she had witnessed it. The little girl had never complained about anyone picking on her before. The mother is very distressed and has said that she is removing her child from our daycare immediately and that if she were to see the little boy, she would "slap him senseless". She signed a contract stating that she would provide 30 days written notice of cancellation. (We only really want 2 weeks, but 30 days is for those that try to stiff us). She has already paid for next week and demanded a refund. My wife said "Under the circumstances, I'll accept the one week you've already paid and call it a wash". This mother was not happy with that and threatened to take us to court. I really don't think she has any kind of case. What possible proof could she have that anything happened. Don't get me wrong, we certainly don't approve of this type of behavior from any of our daycare kids. The little boy in question no longer attends our daycare, he is staying home with family so they can save money.
Should we be at all concerned about being sued over this? If this does go to court, I expect we will countersue for the full 30 days daycare fee since proper notice, according to the signed contract, was not given.
