What is the name of your state?South carolina
Father never paid court ordered child support, mother had to raise three children on welfare while father was living it up.Now we are all grown 28 ,26 ,24
can mother sue for back child support under S.C. law or is it to late?He finally has a good job and is keeping it.

not sure about SC but in NC arrears are arrears are arrears. Meaning that no matter how old the kids are yes you are still due the arrears. The state would be intittled to its money back bc of the walfare the mother recieved. And i'm sure they would be very intrested in collecting.

Check your sate law, or someone else here will tell you but my father in DE just had this happen to him he got zapped for a son that is now 30, lost his license and everything. I am suprised he didnt wind up in jail.

Have your mother call her county's children's services office. They will be able to tell her what to do and will be very interested in the fact that it could mean getting back some of the money it cost them over the years.

If he has assets, such as savings accounts, they may be able to be frozen, or a lien placed on RE. Or both.

If he has no assets, it will need to be collected over time via garnishment- don't plan on a lump sum being out there in that case. Also, the state will be paid back the welfare, so the state will have a claim on collected CS for reimbursement.

So your mother spent her life on welfare but dad is the only deadbeat?

It is entirely possible that the state will get its money back, but Mom could be ruled against for allowing so much time to go by w/o trying to collect.

There is no statute of limitations for child support in the State of South Carolina.

And since she collected welfare her whole life, if she signed her support rights over, the state might collect in order to repay them for all the money they doled out to your mother, but your mother would in fact be double dipping if she tried to collect the money.

In other words, if she collected welfare, he owes the state, not your mother. I'm surprised the state hasn't gone after him.
