I have a question concerning a debt collection company. I was mailed a letter by this debt collection company stating that an account that I had with this military star card was in collection. The debt company called a week later and said, that the reason the account was in collection was because of six months of past due payments. I contacted the military star credit card, they were really not sure why it was in collections, but they was aware it was in collections. So I sent copies of payments that were made to military star card to the debt collection company. They called back and said it was not because of the payments, but because i was making payments through Credit Couselors of America and they said the payments were not enough, and they had no agrrement for the amount that they had accepted for over a year. Before this account was moved to miltary star in June 2000 it was AFEES (the miltary card), and I was never informed that the amount that CCA was sending was not enough. I have received letter from the debt collection agency saying they will accept the amount being paid. They later called ( after the payment was made) and said that they can't accept it, but they did. They want a large down payment, but have never explained to me why my account is in collections. They have also threaten to take my income taxes this year, because of a debt that I'm willing to pay, but not on terms that can't be explained to me. I faxed a letter to mitary star asking for a copy of my account and the letter saying that they didn't accept CCA agreement. I need help on what I should do next. State I'm in is Tennessee

I am not a total expert on this, this is just my understanding.

1) Federal law prohibits the interception of a tax return check (not totally positive on this) even if this is permissible, they must have a judgment to do this.

2) Does the collection agency have a judgment or is this a debt turned over to them???

3) Do you have any paperwork with CCA stating amounts, etc agreed upon and length agreement is in effect?

Check your agreements with CCA and see exactly what the deal was with this debt. Keep trying to work with them and get everything in writing.

Hope there is someone else here that can help out....

SEEMS LIKE TO ME YOUR ACCOUNT HAS BEEN TURNED OVER SO MANY TIMES TO DIFFERNT AGENCIES THAT ONE HAND DOESNT KNOW WHAT THE OTHER IS DOING (AS THE OLD SAYING GOES) DON'T LET THEM STRESS YOU OUT TOO MUCH THOUGH THE COLLECTION REPS ARE JUST DOING THEIR JOB......BUT LIKE THE OTHER LADY SAID GET EVERYTHING IN WRITING......BOTTOM LINE HERE SEEMS LIKE TO ME THAT THEY JUST WANT MORE MONEY THAN YOU'RE ABLE TO PAY RIGHT NOW....AND THAT SINCE THIS IS A NEW COLLECTION AGENCY TRYING TO COLLECT ON YOUR BALANCE THEY MIGHT NEED YOUR PAPERWORK ALL OVER AGAIN...BUT REALLY ALL OF THIS SHOULDVE BEEN KEPT UP ON THEIR END
