I'm being hounded by an agency over an apartment bill. They started out at 2465.00, then dropped it to 1895.00 due to the complex re-renting the unit for the same time they were billing me for. Most of the charges they are claiming are bogus, but i paid for what i owed (510.00). I sent them a certified letter saying I would only pay the 510.00 that I rightfully owed. I also said that I would pay it in 25.00 weekly payments for 19 wks then a final of 35.00. Since I know for a fact that they receive my arrangement and they cashed all the folllowing payments, does that mean they agreed to the arrangement and that I owe no more monies??

I also loaned 4050.00 to a friend (written contract). They were to pay it back once a month at 150.00/mo. They made two payments and stopped, what can I do to recover my money??

two questions for the price of one ---

regarding the apartment -- the creditor is not required to accept your offer to settle the debt for less than the claim -- if you have been sending money then they have almost surely been just applying it to the balance they say you owe.

The only positive way to hash out how much you really owe is in court.

You do have some rights under the FDCPA to demand validation of the debt. But, since more than 30 days has lapsed since the initial contact, you have no way to force a response to the demand.

In my opinion, you need to come to a resolution and have a written agreement -- otherwise, you don't have a clue.

As to your friend --

You have the right to bring a lawsuit to collect the debt. If you win a judgment, you have the right to garnish wages, attach non-exempt property, etc.

You might want to think about finding a small collection agency and asking them to collect it for you. They will charge a percentage of what they collect.
