I hired a private agency to help me collect child support.
The check goes directly to them for the 30% fee deduction then they send it to me. The owner of the agency became a ffriend of my parents and recently offered to help me with a legal matter totally unrelated to child support. He then proceeded to send me a bill for $700.00. I was in shock.
Two weeks after I got his bill he took it upon himself to deduct the amount from my son's child support check. Is this legal?
Thank you

My response:

No, not without your written authority. No one has a right to a "set-off" until a judge says so, or there is written authority from you authorizing such a set-off.

Write him a Certified Return Receipt letter demanding the return of your money within 7 days from the date of your letter. Then, when he fails to comply, take him to Small Claims court to have him explain himself to a judge. You'll get your money back, real quick.
