I am in florida and my house is in foreclosure and I am up to the part of doing a deed in lieu. Well the first contact I got after submitting my papers

for the deed in Lieu was not from the person at the company handing my account but was from a real estate agent calling me about a deed in lease. She

then showed up at my house with papers to sign even after i left a message for her telling her i knew nothing about the deed in lease and wanted to

check with the person handing my case.

I was told that i was going to get relocation money in amount of 3000 to move, so i wanted to confirm this and touch base with the person handing my

case.

well the first message i get back from the person is::

I have been advise the deed for lease has been cancel. Please advise if you will be vacating the property 21 days after you sign the deed in lieu

docs. If you are unable to vacate 21 days after you sign the deed in lieu, deed in lieu will be cancel. Once you are able to vacate 21 days after you

sign the deed in lieu, please contact Bank of America to review and reactivate the deed in lieu. Please advise by today.

then i said i could not move in 21 days and asked if when i get the relocation money and got this reply::

You did not sign the deed for lease, therefore, I need confirmation that you will vacate the property 21 days after you sign the deed in lieu. The

relocation check will be sent after the property has been vacated, the docs have been signed and you and Bank of America and sent to the county for

recording. Please confirm if you are able to vacate 21 days after you sign the Deed in lieu, if you are not able to vacate 21 days after you sign the

deed in lieu, than deed in lieu will be cancel until you are able too. Please advised today.

1.Can i try and save as much money as i can before they push the foreclosure thru and then do the deed in lieu at last second?

2. Is there anyway to get them to give me the money before I move? also a way to have them guarantee the amount?



Any comments or suggestions appreciated.

You can always try. But, there is no guarantee they will accept the deed.

The whole point of the money is to get you out with the least amount of hassle. If they give it to you before you leave, they may be out the money if you change your mind. So, I suspect not. There is no guarantee until you make an agreement. Then you have the rights of a contract.

I suspect that the relocation money offer may be significantly lowered or become non-existent the longer you wait to move out.

The whole point to paying you to relocate is to save them the cost of having to proceed to foreclosure. When they end up having to incur additional costs, including attorney fees, court costs, etc. in order to continue with the foreclosure process, it no longer benefits them to pay you on top of that to vacate.

It also doesn't benefit them to pay you that relocation money until they are sure that you actually intend to vacate the property instead of dragging this whole thing out longer.
