I live in Michigan. My mother has been renting a house for over 4 years through Section 8 housing. The mortgage for the home is about $500 more a month than Section 8 pays. The landlord could no longer pay the difference. So he contacted the bank and requested a deed in lieu of foreclosure. The request was accepted, and he called my mother Nov 30th and told her she had until Dec 5th to vacate the premises because he was giving it to the bank. She is on a month to month lease, but Decembers rent has already been paid. And there is no physical way she vacate on such short notice. The landlord said if she doesnt vacate he will go forth with eviction, and being on Section 8, if you are evicted, you are kicked off . Shes more than willing to move and said she will be out by the end of the month, but he isnt agreeing with that. Is this legal? Does she have any rights? Can the bank come in and lock her out of her home? Im just looking for some more information on situations like this. Whatever info is greatly appreciated!

He accepted December rent. He can't evict her. She needs to call Section 8 and explain the situation.

Something smells here. If section 8 is involved there is a lease of at least a year in duration. When is that lease up? As long as she pays the rent (and still qualifies for the section 8 vouchers), he can't just evict or end things because he doesn't like his financial situation. I suspect the bank won't take a deed-in-loo when there is a renter so that's why he wants her out. However, if they do accept the dil, her lease is UNAFFECTED.
