my father-in-law passed away leaving behind a vehicle he hadn't finished paying for. My mother-in-law wanted to keep the vehicle and informed the car dealer in November of my dad's passing and that she would continue to make the payments. She has power of attorney over my father-in-laws property and asked that her name be added to the vehicle contract . The dealer has continued to accept the payments for 10 months now and still has not added my mother-in-laws name to the contract and just last week requested the vehicle back. The vehicle was a $40,000 and is half paid. The blue book says it's worth $28,000. We feel the dealer is defrauding a widow since they obviously can get more reselling the vehicle than is left on the original contract. Does she have any rights? Can they take the vehicle back after leaving it in her possession this long? What is the name of your state (only U.S. law)? Maryland

a POA ceases at death so that does her no good here.

The lender does not have to put her on the loan contract.
