Delayed settlement!

Recently I settled a law suit against my employer September 7,2000 and signed the release papers on September 22,2000.
I have been waiting for the settlement check since then. I called my attorney and asked what was going on with my case and he told me that the company lost my release form and they are going to send me another one to be signed. My question is, can I go back to a certain date and ask for any interest on the settlement because I would have put it in a CD and request that they pay for any interest payments I paid to credit card companies and loans that I would have paid in full with the settlement check?

You can ask but I doubt you or your lawyer would want to upset the settlement for 45 days interest and the rate that would be paid is about 6%, not your credit card rates..

I don't think 6% interest for 45 days would be worth what you may stand to lose.Once the insurance company gets that notice, they will have to take time to go over it with attorneys, thereby delaying your payment even more.Now, I'm not a lawyer, but it seems you may be opening a can of worms. There could be a statute where you are that would allow them a new trial because of it and this time you may lose. WAIT ON THE CHECK.
