My boyfriend was denied citizenship earlier this year on the basis of a 1992 conviction for domestic violence. Now it looks like his application to renew his green card may be denied. The 1992 conviction was based on the advice to plead guilty from his public defender who did not bother to discuss the facts of the case with him(he was falsely charged). He followed this advice since he had already been held in jail for 3 days and had been told by counsel that this was the easiest way to get out and make the case "go away". Is there any recourse we can now take with INS? We live in California.

All you can do is fight to have the conviction quashed.. but I do not believe you could after all this time.
