Denial Of Visitation

What is the name of your state?What is the name of your state?North Carolina I am filing court papers next week concerning Denial of Visitation. I have joint custody (NCP) and every other weekend visitation during the school year. My ex has denied my scheduled visitation on 2 consecutive weekend visitations and refuses to discuss this issue with me in person or by phone. I have not seen or spoken to my children since Aug 3rd. There was a custody dispute in court two years ago (she won, long story) in which she requested that she be allowed to bring the children to me on Friday at 6PM and I was to return on Sun 6PM. This is the pattern that has been followed since that time. She called my office at 1AM Friday morning (approx 17 hours notice) to inform me that she would be working and was unable to bring the children. She works a food service job and her schedule is very flexible. My sons are 15 & 13 years old. My ex also has 4 other younger children with different fathers. My questions are;

· What can I expect as the best/worst case outcome of this court hearing?
· Will her previous visitation denials be a factor the judge will consider?
· What are the procedures that will take place in the courtroom?
· Will I be able to conduct this hearing without an attorney?
· What documents will I need to bring to court?

1. Best case: You get make up time and she gets a stern warning by the judge that if she denies visitation again, she will lose custody. Worst case: the judge does nothing to her.

2. If you've taken her for contempt of court for denying visitation prior to this, the judge isn't going to like seeing her again for the same problem.

4. Yes, but you need to be prepared and understand the law. Feelings and emotions must be put aside, stick to the law.

5. I don't know. Honestly, if you don't know you should hire an attorney.
