I live in TEXAS. I have custody of my nephew, went to court got emergency custody then biological mom signed papers & gave me custody.He was 1. now's he's 6. he hates to go to her home and spend the nite. her new hubby is controlling & has domestic violence against him once 6-98 & other legal issues. he has hit child 2 x one time i contacted cps. 2nd time left a bruise & I filed police report. she is supposed to get him for 30 days in summer. I'm afraid for him to be with them for that long of a time. she denies child was hit,then called child a liar both times. How much trouble can I get in for not letting her have him? Should I just refuse to let her have him anymore and let her take me to court or should I get attorney and take her to court first? Last time he was hit was Dec 2000 & he has been going there every other weekend but cries when he has to go and became terribly upset when I told him that he had to spend 30 days with her for summer. He's in a pre school program for children with disabilities, speech & motor skills caused by no stimulation from birth to 1 yr when she abandoned him with me & didn't return for 4 mon. Should I refuse to let her have him next visit & what kind of trouble can I get in for doing that if she takes me to court. I have documented all of this and have witnesses as to him not wanting to be with her. Help Please, CPS is NO help
