What is the name of your state (only U.S. law)? ga. my son has joint custody of his 10 yr old with an ex girlfriend, who has harbored jealously and much dislike toward his wife. she (wife) recently got into some legal trouble (went to jail for contributing to the delinquency of a minor-her son). my son was out of town working when the wife went to jail, so the 10 yr old was with his mother (the ex). she has now decided that my son can no longer see his own son as long as the wife (now out of jail) is around. child is in absolutely no danger as my daughter in law now lives in my house. son comes up from fl every weekend, so all would be here with me. question is, can she legally keep him from seeing his son without a court order? What is the name of your state (only U.S. law)? What is the name of your state (only U.S. law)?

Your simple answer is "no", she can not arbitrarily deny visitation. She would have to go to court to get a temporary order or a modification to the original order, that is depending on what the original order stipulates.

Your son can take the ex-wife to court to enforce the order. However, he had better get his ducks in a row as his wife's charges are relevant and he may have a lot to overcome.

Seek the advice of a lawyer.

Absent a court order that allows her to withhold the child, he needs to go and try to pick up the child. If mom refuses the pickup, have it documented that mom has refused (think a police report). Mom continues to deny, dad can go to court asking for a show cause hearing.
